REGULATIONS OF
THE GLOBAL BOXING CLUBS NETWORK

These Regulations (hereinafter referred to as the “Regulations”) define the rules for conclusion and termination of agreements, rules of membership and use of boxing clubs run under the brand name GLOBAL BOXING by Global Boxing sp. z o.o. with registered office in Warsaw / Warszawa, ul. Ludwika Nabielaka 6/4, 00-743 Warszawa, entered into the Register of Entrepreneurs kept by Sąd Rejonowy dla m.st. Warszawy in Warsaw / the District Court for the capital city of Warsaw in Warsaw, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego / 13th Economic Division of the National Court Register/ under KRS number 0001094625, NIP 5214061786, REGON 528100738, with share capital of of PLN 20,000.00.

  1. GENERAL PROVISIONS

A person using the services offered by the clubs operating under the brand name GLOBAL BOXING, enters into a Club Use Agreement with Global Boxing sp. z o.o. with its registered office in Warsaw, ul. Ludwika Nabielaka 6/4, 00-743 Warszawa, entered in the Register of Entrepreneurs kept by the District Court for the City of Warsaw in Warsaw, XIII Economic Division of the National Court Register under the KRS number 0001094625, NIP 5214061786, REGON 528100738, with the share capital of PLN 20,000.00, (hereinafter: “Global Boxing sp. z o.o.”).

  1. DEFINITIONS

Basic terms used in these Regulations mean:

a) Application – Global Boxing or Fitssey mobile application available for download in the App Store or Google Play.

b) Global Boxing – Global Boxing sp. z o.o. with its registered office in Warszawa, ul. Ludwika Nabielaka 6/4, 00-743 Warszawa, entered into the Register of Entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number 0001094625, NIP 5214061786, REGON 528100738, with share capital of PLN 20,000.00.

c) Club Member or Customer – a person using the services offered by Global Boxing who has fulfilled the conditions specified in these Regulations.

d) Payment Date – The payment date shall be the date on which the Customer joins the Club or any other date chosen by the Customer to commence membership.

e) Night Hours – the working hours of the Club from 22:00 to 6:00, during which no Club staff is available at the disposal of Club Members.

f) Pass or Subscription – a subscription that entitles a Club Member to use the services on the current Global Boxing offer, for the period and under the terms and conditions specified in the Membership Agreement.

g) Club – the location selected by the Customer in the online system when purchasing a Subscription.

h) QR Code – an alphanumeric, two-dimensional, matrix, square graphic code, downloadable in the Application.

i) Customer Zone – an area accessible to the customer after logging in to their individual profile using www.globalboxing.com allowing payment of membership, cancellation of membership, access to invoices and all information about membership and purchased services.

j) Billing Period – the billing period is a calendar month and begins on the Payment Date.

k) Membership Fee – a fee which enables you to use the services offered by the Club.

l) Registration Fee – a fee that may be charged in connection with becoming a Member of the Club.

m) Membership Agreement – a contract for the provision of services concluded between Global Boxing and the Customer on the terms and conditions set out therein.

  1. MEMBERSHIP
 
  1. Global Boxing Club Member status is obtained by fulfilling the following conditions:

a) online registration in the Customer Zone at www.globalboxing.com or via the Application;

b) activation of the Subscription and payment of the Pass, i.e. payment of the Membership Fee and, in certain cases, also the Registration Fee;

c) in the case of minors who turn 16 in the calendar year in which they wish to purchase a Subscription, the written consent of their legal guardians for the purchase of membership and use of the services offered by the Club by such minors.

  1. Access to the Club and the right to use the services offered by the Club is obtained by the Club Member after:

a) installation of the Application on his/her smartphone;

b) the expiry of the deadline for withdrawal from the Agreement indicated in point V of the Regulations, unless the Customer has made a declaration requesting the commencement of services by Global Boxing before the expiry of the deadline for withdrawal from the Agreement.

  1. The Club Member does not receive a card or any other document allowing entry into the Club. Entry to the Club is granted by presenting the QR code generated in the Application.
  1. The Club Member is entitled to use the Club assigned to the location selected in the online system when purchasing the Card or selected in the Application. The Club Member is entitled to use the Clubs assigned to other locations only when purchasing a Club Pass entitling to use more than one Club.
  1. Membership shall be terminated:

a) at the end of the time for which the Membership Agreement was concluded, in the event that the Customer does not wish to continue the Subscription and does not pre-pay the Subscription for further Billing Periods;

b) as a result of a voluntary resignation submitted by the Customer online in the Customer Zone at www.globalboxing.com or in the Application, with one month’s notice effective at the end of the Billing Period following the month in which the notice was submitted;

c) in other cases indicated in the Regulations.

  1. Club Membership status may be reacquired upon fulfilment of the conditions set out in point 1 above.
  1. The club member can be a person without medical contraindications:

a) who is over 18 years of age and has full legal capacity,

b) a minor who will be 16 years of age or older in the calendar year in which he/she wishes to become a Club Member, after providing the Club with a statement signed by his/her legal guardians giving their consent to the minor purchasing a Club Pass and using the services offered by Global Boxing. At the same time the legal guardian is informed by the content of the aforementioned statement that a minor who will be 16 years of age in the calendar year in which he/she wishes to become a Club Member will perform the exercises independently and that Global Boxing is not responsible for accidents and injuries resulting from non-compliance with the rules of safety and use of the Club.   1. In the event of medical contraindications, a person may become a Club Member at their own risk.
  1. As part of the paid-up Pass, the Club Member is entitled to use the activities indicated in the schedule without limitation, subject to the following: there is a booking requirement for classes, which must be made via the Customer Zone. Enrolment for classes starts one month in advance before the start date of the class, with the proviso that you can only enrol for classes that fall on a date when the Pass is valid and paid for. Global Boxing is entitled to verify attendance prior to the commencement of each class by reading out the name of the Club Member who made the booking as described above in the presence of others. In the event of no vacancies, Club Members who have not booked in advance will not be allowed to attend classes.
  2. Global Boxing reserves the right to verify attendance at classes over the last 60 days. In the event of two recorded absences from a class, previously booked and not cancelled, Global Boxing has the right to block enrolment in the class for a period of 7 consecutive days following the class in which the second absence was recorded.
  3. Both class registration and cancellation are mandatory and take place via the Customer Zone. Access to the Customer Zone is possible by logging in at www.globalboxing.com or via the Application. Cancellations are possible no later than 24 hours before the scheduled class.
  1. CONCLUSION OF THE CONTRACT AND PAYMENT
 
  1. The contract between the Customer and Global Boxing is concluded:

a) by creating an account at one of the Clubs belonging to the Global Boxing network of Clubs and then activating the Subscription and paying for it by the method listed in these Regulations, or

b) filling in the form placed on the website www.globalboxing.com or in the Application, and then activating the Subscription and paying for it by the method mentioned in these Regulations.

  1. The contract with Global Boxing is concluded for a fixed period of time, chosen by the Customer (Prepaid Subscription).
  2. Membership is renewable each time after payment is made for the next Billing Period.
  3. The pass prices presented on the website www.globalboxing.com and in the Application are gross prices (including VAT) and are in PLN. Following payment, an invoice is issued and made available to the Customer in the Customer Zone.
  4. Global Boxing uses a cashless payment system.
  5. The Customer shall make payment:

a) upon activation of the Subscription – upon conclusion of the Membership Agreement with Global Boxing, by debit to a payment card or via an external payment system (eTransfers);

b) for the second and subsequent Billing Periods – in the Billing Periods by means of a cyclical charge to the payment card or each time via an external payment system (eTransfers).

  1. If a Payment Day falls on a day that is not a Business Day, direct debit instructions will be executed on the next Business Day following the Payment Day.
  2. The Club Member must ensure that there are funds in their bank account so that the necessary amount to pay for the Subscription is in their account on the Payment Date.
  3. In the event that funds cannot be debited from a Club Member’s account, several attempts will be made to debit the Club Member’s account. In the event of unsuccessful debit attempts, Global Boxing has the right to temporarily suspend the ability to use the Club or cancel the Subscription completely.
  4. In the event of payment arrears, in particular failure to pay the Subscription on time or failure to debit the Customer’s account by the date specified in the contract, the Customer forfeits the possibility to use the Club until the arrears are paid. This does not exclude the obligation to pay further fees until the Membership Agreement is terminated or dissolved.
  5. In the event of non-payment of the Membership Fee and, in certain cases, the Registration Fee by the start of membership, Global Boxing has the right to terminate the Membership Agreement with immediate effect.
  6. The Customer may resign from renewing the Subscription for subsequent Billing Periods (cancellation of the Subscription) with one month’s notice, and the Membership Agreement with Global Boxing will be terminated effective at the end of the Billing Period following the month in which the notice was given. In order to give notice of cancellation, the Customer, after logging into his/her Customer Zone, clicks on the appropriate button which constitutes an instruction to cancel the Subscription.
  7. Global Boxing reserves the right to give customers discounts on the current: Registration Fee or Membership Fees;
  8. The discount will be given in the form of a discount code generated by the computer system;
  9. The discount code mentioned above can be given to the customer by a Global Boxing employee or by a person cooperating with Global Boxing on a different basis, including, but not limited to, personal trainers who are not Global Boxing employees or under the terms described in separate Regulations;
  10. The Customer receives the discount code from the person mentioned above in electronic (e.g. e-mail) or paper form;
  11. The discount code given to the customer is not subject to sale;
  12. Global Boxing stipulates that the decision to establish a discount and the criteria for granting a discount are at the discretion of Global Boxing.
  1. RIGHT OF WITHDRAWAL
 
  1. Conclusion of the Contract by the Customer via the Internet (online) treated as conclusion of a distance contract within the meaning of the provisions of the Consumer Rights Act of 24 June 2014 (Journal of Laws of 2014, item 827, as amended).
  2. The Customer who has concluded the Agreement in one of the ways referred to in paragraph 1 above has the right to withdraw from the Agreement, which must be exercised within 14 (in words: fourteen) days of the conclusion of the Membership Agreement.
  3. The right to withdraw from the Membership Agreement shall be exercised by the Club Member submitting a written declaration of withdrawal from the Agreement. The written declaration must contain at least the following:

a) designation of Global Boxing’s details;

b) designation of the Club Member’s details;

c) date of declaration;

d) a statement of withdrawal which reads: “I (name) hereby give notice of my withdrawal from the Membership Agreement concluded on (date)”. – or equivalent.

  1. In the event of the effective exercise of the right of withdrawal from the Membership Agreement as indicated in point 3 above, the Club Member is entitled to:

a) if he/she has not made the declaration mentioned in point III, section 2b of the Regulations, Global Boxing shall, within 14 (in words: fourteen) days from the date of receipt of the declaration of withdrawal from the Contract, refund the fee paid by the Customer at the conclusion of the Contract to the bank account from which the fee was paid, using the same method of payment that the Customer used when making the payment;

b) if he/she has made the declaration mentioned in Point III section 2b of the Regulations, Global Boxing, within 14 (read: fourteen) days from the date of receipt by Global Boxing of the declaration of withdrawal from the Contract, it shall refund the fee paid by the Customer in the course of concluding the Contract to the bank account from which the fee was paid, using the same method of payment which the Customer used in making the payment after deducting the remuneration for the possibility of using the Club for the period from the date of acquisition of membership to the date of submission to Global Boxing of the notice of withdrawal from the Contract, the remuneration due to Global Boxing shall be equal to the portion of all fees paid by the Club Member proportional to the number of days from the date of acquisition of membership to the date of receipt by Global Boxing of the notice of withdrawal, in relation to the number of 30.

  1. USE OF THE CLUB
 
  1. The following Rules for the use of the Club are established:

a) The Clubs are open 24 hours a day, 365 days a year. The Clubs’ receptions are open from 6:00 am to 10:00 pm.

b) Individual Club rules or functional area rules have been established for each Club, which contain, in particular, provisions on the appropriate use of the Club, the equipment located therein, and respect for the rights of other Club Members. Each Club Member is obliged to become familiar with and comply with the rules; the Club Member is obliged to use the premises, facilities and equipment belonging to the Club in a manner consistent with their intended use.

c) The Club Member is materially liable for damage to or destruction of Club premises, facilities or equipment.

d) Entry to and exit from the Club is permitted only after downloading a QR Code from the Application and applying the downloaded code to the reader at the entrance gate. It is forbidden to allow third parties to enter and leave the Club by opening the entrance gate using a generated QR Code from the Application installed on one’s smartphone. Behaviour contrary to the above will be considered as a breach of the Club rules. Global Boxing has the right to cancel the Club Member’s membership with immediate effect, in which case the Club Member specified above is obliged to pay to Global Boxing, within 7 days from the date of cancellation of membership, a contractual penalty in the amount of 100 (in words: one hundred zlotys), which will be set off against the claim for the return of unused funds from the paid membership. Global Boxing has the right to claim compensation on general terms exceeding the amount of the penalty stipulated above. Global Boxing also reserves the right to impose a lifetime ban on access to its clubs.

e) The Club Member is obliged to comply with the fire regulations and the instructions for the use of the various rooms, facilities and equipment belonging to the Club, and in particular the instructions given by the instructors and other Club staff.

f) The Club Member is obliged to keep and maintain cleanliness and to comply with generally accepted standards of behaviour when using the services of the Club. It is unacceptable to hinder or prevent the use of the Club to other members, as well as to insult or threaten them in any way, including the use of insulting words in the Club area despite notices from the Club staff. Behaviour that is offensive to the dignity of other Club members, including vulgar or obscene behaviour, or that is racist, harassing or discriminatory on grounds of race, religion or gender is also unacceptable.

g) Consumption of alcohol or other intoxicants and smoking on the Club premises is prohibited. Club members who are in a state indicating the consumption of alcohol or other drugs will not be admitted to the Club premises. The above-mentioned Club Member is obliged to pay to Global Boxing, within 7 days from the date of loss of membership, a contractual penalty in the amount of 100 (in words: one hundred zlotys), which will be deducted from the claim for refund of unused funds from the paid membership. Global Boxing has the right to claim compensation on general terms exceeding the amount of the penalty stipulated above.

h) Filming and photography for commercial purposes without permission from Global Boxing on Club premises is forbidden. Global Boxing may make the granting of permission to film and photograph subject to payment of a fee. Contact for permission: contact@globalboxing.com.

i) The Club Member is required to wear interchangeable indoor sports footwear in the Club area, with bathing shoes with rubber non-slip soles in areas such as bathrooms and shower rooms.

j) The Club member should be provided with a padlock for the locker to ensure the security of any items left in the locker (applies to Clubs where lockers do not have a security code).

k) Before starting a training session, the Club Member is obliged to prepare the exercise area so that the exercises can take place in a safe manner for him/her and the surroundings and to check that there are no other obstacles preventing the exercise.

l) Global Boxing provides Club Members with the opportunity to learn the basic principles of safe use of the equipment at the Club by running free introductory classes.

m) Each Club Member exercises at their own risk.

n) Global Boxing and the instructors are not responsible for accidents and injuries occurring on the Club premises as a result of non-compliance with these Regulations and the Club Regulations by Club Members. The Club Member uses the Club at his/her own risk and cannot make any claim against the Club for injury or loss of health in connection with the use of the Club’s services, unless caused by the Club in a culpable manner.

o) The Club member is required to leave their belongings in the lockers provided for this purpose. Lockers must, depending on the Club, be secured with a padlock or security code to prevent them from being opened. Global Boxing accepts no responsibility for items left on the Club premises, in places not designated for this purpose, or for items left in an inadequately secured locker.

p) Lockers in the Club are emptied and cleaned daily after the Club closes, during the general cleaning of the dressing rooms. Items left in lockers will be deposited on the Club premises and may be collected at the Club within 3 days of being deposited. After this period they are deemed abandoned in accordance with Article 180 of the Civil Code and will be discarded, recycled or donated to charity.

q) It is forbidden to leave items in lockers for a period exceeding the time of a single training session, during which lockers should be closed. The client is obliged to take his/her belongings from thelockers with him/her when leaving the Club at the end of the training session.

r) In situations not covered by these Regulations, the Club manager, or other person who has the authority to make decisions on behalf of Global Boxing, has the right to arbitrate decisions regarding the operation of the Club, in particular to determine the possibility of entry into the Club.

s) It is forbidden to carry out any profit-making activity on the Club premises without the permission of Global Boxing, in particular commercial, marketing and service activities, including trainings, workshops, coachings.

t) Only trainers who have purchased the Trainer’s Pass entry to the Club are entitled to conduct personal training sessions at Global Boxing. It is forbidden to sell trainings and conduct them by other persons. In the event of a breach of the provisions of this point or behaviour by a Club Member contrary to the principles of social co-existence or good morals, Global Boxing has the right to terminate the Club Member’s membership with immediate effect. The Club member named above is obliged to pay Global Boxing, within 7 days from the date of loss of membership, a contractual penalty of 100 (in words: one hundred zlotys), which will be deducted from the claim amount for refund of unused funds from the paid membership. Global Boxing has the right to claim compensation on general terms exceeding the amount of the penalty stipulated above.

u) It is forbidden to wear on the club premises clothing clearly marked with the names: “trainer”, “personal trainer”, “accredited trainer”, “instructor” by trainers who do not cooperate with Global Boxing and who do not have purchased trainer passes. Individuals who do not comply with this provision may be asked to leave the club by the manager. In cases of non-compliance, Global Boxing has the right to revoke a Club Member’s status.

v) Trainers working with Global Boxing are required to move around the Club in identical coaching attire with the Global Boxing logo prominently displayed and marked ‘trainer’, ‘personal trainer’.

w) Zajęcia zorganizowane:

i. Organised classes are all classes conducted in groups of at least 6 persons and a maximum of 24 persons using a virtual trainer.

ii. Organised classes are held under the rules set out by Boxing.

x) Global Boxing informs that the premises of the facility are monitored for security reasons. The material so collected may be used as evidence in the event of any legal dispute.

y) The Club premises are entirely private and are not public spaces or places open to the public. Only certain persons may be on the Club premises, at certain times and meeting certain criteria under these Regulations. It is not permitted for members of the public regardless of the entity represented to move freely within the Club premises. Any attempt to interfere with the Club’s service providers or administration will result in the relevant services being called in on charges of obstructing the operation of the Club and harassment. A penalty will also be imposed each time members of the public obstruct the operation of the Club, on an hourly rate scale relative to the Club’s daily turnover as compensation for interfering with the proper functioning of the Club and not being able to provide services to Club Members.

z) It is strictly forbidden to hold sparring matches during the night hours.

aa) In other cases, the organisation of sparring matches on the Club’s premises is only permitted in the presence of a trainer and only by prior arrangement of the sparring date with Club staff.

bb) Global Boxing does not assume any responsibility for accidents or injuries occurring during the use of the Club by the Club Member during Night Time, i.e. during hours when Club staff is not available at the Club.

  1. PERSONAL DATA PROTECTION AND PRIVACY POLICY

 

From 04-23-2024 data processing procedures are described in Global Boxing’s Privacy Policy published at  www.globalboxing.com.

  1. OTHER PROVISIONS
 
  1. Global Boxing has the right to temporarily not provide services and to close the Club facility, or part of it, in order to carry out maintenance, renovation or other activities that prove necessary for the proper operation of the Club and the provision of services at the highest level. In the event of the complete closure of a given Club, the Customer will be entitled to a refund of monies paid, in proportion to the period for which services were not provided by Global Boxing (this does not apply to Customers who have purchased a Subscription which entitles the Customer to use more than one Club).
  2. Global Boxing has the right to change, remove content and features provided on the websites including the Customer Zone and provide new content and features or close the websites completely at any time. Global Boxing, taking into account the interests of Members, will notify Members in advance in an appropriate manner of any such major change, especially the closure of the website for an extended period. If you have any questions or wish to do any action at the time of the closure of the website, please contact customer services via the contact form at https://globalboxing.com/en/contact.
  3. Prior to using the Club’s services for the first time, the Customer is obliged to familiarise himself/herself with and comply with these Club Network Regulations and the Individual Club Regulations at the location chosen by the Customer.
  4. In the event that the provisions of these Regulations are breached or the Club Member’s behaviour is contrary to the rules of social coexistence or good morals, Global Boxing has the right to revoke the Club Member’s membership with immediate effect. The Club Member indicated above is obliged to pay to Global Boxing, within 7 days from the date of loss of membership, a contractual penalty in the amount of 100 (in words: one hundred zlotys), which will be deducted from the claim amount for refund of unused funds from the paid membership. Global Boxing has the right to claim compensation on general terms exceeding the amount of the penalty stipulated above.
  5. If you have any feedback on the operation of the Club, questions, complaints or requests, please contact us via the contact form at https://globalboxing.com/en/contact/. Global Boxing undertakes to respond to any of your suggestions within no more than 30 working days.
  6. These Regulations enter into force on the date of publication.
  7. The Regulations may be changed. Each Club Member will be informed of the content of any changes to the Regulations by Global Boxing posting a message on the website www.globalboxing.com about the changes to the Regulations, containing a summary of the changes to the Regulations and maintaining this information on this website for at least 7 consecutive calendar days, and Club Members will additionally be notified by Global Boxing by sending a notice containing a summary of the changes to the Regulations to the email address they have indicated. A Club Member has the right to cancel his/her membership within 7 days of publication.
  8. Amendments to the Regulations, resulting from changes in generally applicable laws, do not require the publication of the amended Regulations.
